Upper Tribunal grants Amarjit Seehra’s client permission to bring judicial review

The Upper Tribunal has granted Amarjit Seehra‘s client permission to bring judicial review proceedings against the Secretary of State for the Home Department after she made the decision to refuse the client’s fresh claim on asylum and human rights grounds.

The Upper Tribunal noted the low threshold in relation to arguability and also determined that the Secretary of State had arguably failed to analyse Amarjit’s client’s ability to access medical treatment in circumstances where he had previously been ill-treated by the Sri Lankan authorities.
