Jonathan Martin granted permission on the basis of contact ordered by the family court

Upper Tribunal Judge Perkins granted permission in a Judicial Review claim where Jonathan Martin had persuaded him it was arguable that the Home Office should not have certified as clearly unfounded the claim of a man who was seeking contact with his daughter. The Home Office had said his contact application was just trying to frustrate or delay removal when the only reason he had come to the authorities’ attention was because he had to report the loss of his passport to the police before he could apply to the family court.
