Family Law Fees – Public Access Work

A number of our family law Barristers at 10 KBW undertake Public Access work. This means that they are qualified to take instructions directly from members of the public as well as from solicitors.

This Public Access work includes representing parties in financial disputes arising out of divorce. These types of cases typically involve a number of different hearings, including a first appointment hearing, a financial dispute resolution appointment and a final hearing. The length of a case from beginning to end will depend on its complexity but even cases which are considered more straight forward may take at least eighteen months to resolve.

The type of work our Barristers undertake on a Public Access basis for financial disputes arising from divorce may include:

  • Advising you on the merits of your case and the way in which it is likely to proceed;
  • Appearing on your behalf to argue your case at court;
  • Drafting documents such as your witness statement, position statement and skeleton argument

Our Barristers receive instructions on a fixed fee basis which may, in cases where the joint assets are worth up to £500,000, range as follows depending on the Barrister’s seniority:

  • Written advice (to be provided within 4 weeks of instruction): £1,000 to £4,000 plus VAT
  • Preparation of case including drafting of documents: £1,500 to £4,000 plus VAT
  • First appointment: £1,500 to £4,000 plus VAT
  • Financial Dispute Resolution appointment: £3,000 to £5,000 plus VAT
  • Final Hearing (first day): £4,000 to £7,000. For each following day:  £1,500 to £3,000 plus VAT

For hearings outside London, the cost of the Barrister’s travel will also be payable.

Please do not hesitate to contact our clerking team should you wish to discuss a Public Access matter further.
