Ahmad Badar led by Zane Malik KC instructed by Mahnoor Shahid of Privity Legal were successful in having permission granted on all grounds in the matter of a private security firm which held a skilled worker sponsor licence. The licence was revoked by the Secretary of State for the Home Department on allegations of non genuine vacancies, operating as a recruitment agency and assigning Certificates of Sponsorship that are disproportionate to its business profile.
Permission was granted on procedural fairness grounds (intelligence phase and interview), rationality grounds and misconstruction of the Sponsor Licence guidance.
