James Bogle in Court of Appeal win

Civil Team leader, James Bogle, acting for the appellant, succeeded in a recent appeal to the Court of Appeal, the Master of the Rolls presiding, in a case involving a retailer’s authority to act as the agent of a finance company to receive notice of revocation.

In C F Asset Finance Ltd v Okonji and ors [2014] EWCA Civ 870, the Court of Appeal held (Lord Dyson MR, Sullivan and Patten LLJJ) that, where a trading agreement between a retailer and a finance company gave the retailer authority to act as the finance company’s agent for the purpose of introducing customers and submitting proposals, it also gave the retailer at least ostensible authority to receive and communicate notice of the revocation of any such proposals.
